New planning application fees published

The Town and Country Planning (Fees for Applications and Deemed Applications) (Amendment) (England) Regulations 2010came into force on 26 February 2010. They apply only to England.

The new regulations provide for fees to be payable for applications for:

  • A new planning permission to replace an existing permission for development that has not yet commenced.

  • A non-material change to an existing planning permission.

On 20 January 2010, the Department for Communities and Local Government announced that fees for planning applications would be frozen, and that fees for planning appeals will not be introduced this year.
