Burden of proof shifts in claims for discrimination on grounds of colour
In Abbey National PLC and Hopkins v Chagger UKEAT/0606/07 & 0037/08; Chagger v Abbey National PLC and Hopkins UKEAT/0041/08 the EAT held that the shift of the burden of proof in accordance with section 54A of the Race Relations Act 1976 does apply in claims for discrimination on grounds of colour. The EAT also held that the tribunal had erred in several respects in its assessment of the employee's losses when determining remedy. This update first appeared in last week's e-mail.
