Swiss Rules of International Arbitration

In order to promote institutional arbitration in Switzerland and to harmonise the existing rules of arbitration, the Chambers of Commerce and Industry of Basel, Bern, Geneva, Neuchâtel, Ticino, Vaud and Zurich have adopted the present "Swiss Rules of International Arbitration", which replace the formerly different rules of international arbitration of these Chambers. The Rules can be downloaded as a PDF file in English, German, French, and Italian. Other languages will follow.

For domestic arbitration the existing rules of the six Chambers still apply.

Comparison with UNCITRAL Arbitration Rules

The Swiss Rules of International Arbitration are based on the UNCITRAL Arbitration Rules, to which two main types of changes and additions have been made:
  • Changes and additions required to adapt the UNCITRAL Arbitration Rules to institutional arbitration;
  • Changes and additions reflecting modern practice and comparative law in the field of international  arbitration.
These changes and additions have been deliberately kept to a minimum. A comparative version of these Rules, in which the modifications to the UNCITRAL Arbitration Rules are italicised, can be downloaded as a PDF file, here.

Swiss International Arbitration Law

The law of international arbitration in Switzerland is set out in Chapter 12 of the Private International Law Act 1987, which can be downloaded in its official version in German, French and Italian and in an unofficial English translation.
